These terms describe the Merle website, professional dashboard, and Spriggy speech-practice app provided by Merle Speech Technologies LLC. By creating an account or using the Services, you agree to these terms. If you act for a school, clinic, or other organization, you must have authority to do so. 1. Accounts and authorized use
Adult account holders are responsible for accurate account information, protecting their credentials, and using only student and family information they are authorized to access. Do not share logins or use another family's invitation code. Let us know promptly if you suspect unauthorized access.
Children use Spriggy under an authorized adult's supervision. An adult account, a paid subscription, or acceptance of these terms does not replace required parental consent or school authorization to collect a child's information.
2. Plans and availability
Merle Free provides the homework assignment and tracking features described on the pricing page. Merle School adds scheduling and reporting and costs $7.99 USD per SLP per month, with no active-student cap at this time. A School subscription is for one SLP account.
Merle Pro is coming soon and cannot currently be purchased. Announced future features are not included in a current subscription unless expressly made available in that plan. Consult the pricing page and checkout for the features and price offered when you subscribe.
Spriggy family access is separate from Merle School. Paid Spriggy subscriptions, when offered, are purchased and managed through Apple's App Store; a School purchase does not purchase an Apple subscription.
3. School billing and automatic renewal
Stripe processes Merle School website payments. By completing subscription checkout, you authorize the price shown at checkout to be charged each month until you cancel. Any applicable tax charged is shown before payment. There is no annual commitment in the monthly plan.
Your dashboard's Plan & billing page provides billing history, available Stripe invoices and receipts, and access to subscription management. Payment information is handled by Stripe; Merle does not receive complete card numbers.
If a payment fails, paid access may be interrupted until the subscription is active again. A purchase confirmation depends on verified payment information, not merely returning to the website from checkout.
4. Cancellation and billing questions
To stop School renewal, open Plan & billing → Manage subscription & receipts in the Merle dashboard and cancel in the Stripe billing portal. Cancellation is scheduled for the end of the paid period; you retain paid access until the displayed end date. Cancel before the next renewal to avoid another charge.
Cancellation does not automatically issue a refund for an already-paid period. If a charge is incorrect or you want a refund reviewed, contact spencer@merlespeech.com. Nothing in these terms limits refund or cancellation rights provided by applicable law.
Manage Spriggy App Store subscriptions and refund requests through Apple. Deleting a Merle or Spriggy account does not by itself cancel an Apple subscription. If you cannot reach the School cancellation controls, contact us for assistance.
5. Speech practice and professional judgment
Merle and Spriggy support speech practice and professional review. Automated recognition, scores, and coaching can be inaccurate, including because of recording conditions, age, accent, dialect, or speech differences. They are not a medical diagnosis or a substitute for an SLP's judgment.
Professionals are responsible for reviewing generated reports and verifying their accuracy before using them for clinical decisions, school records, or IEP documentation. No particular clinical outcome or acceptance of a report by a school is guaranteed. These Services are not for emergencies. Stop an activity and consult the child's professional if a cue causes discomfort or conflicts with their guidance.
6. Your content and privacy
You retain your rights to the content you provide. You permit Merle and its service providers to store, process, and display it as needed to provide the Services, handle your requests, and protect the service, as described in our Privacy Policy. Do not upload content that you lack permission to provide.
Our Privacy Policy explains information collection, speech processing, access, retention, and deletion. Schools and clinics may have additional agreements and recordkeeping obligations. These terms do not themselves create a Business Associate Agreement or certify compliance with HIPAA, FERPA, or other privacy laws.
7. Appropriate use
Do not attempt to access another user's records, defeat access controls, upload harmful software, interfere with the service, or use the service unlawfully. Do not misrepresent practice results or disclose a child's information to people who are not authorized to receive it.
Merle's software, artwork, and other service materials remain the property of Merle or its licensors. You may use them through the Services for their intended purpose; these terms do not transfer ownership of those materials to you.
8. Service changes and account closure
An internet connection is required for services such as authentication and cloud speech assessment. Outages, maintenance, and third-party interruptions can delay access or results. Contact support if records appear incomplete or incorrect.
We may restrict access to address misuse, security threats, or legal requirements. You may stop using the Services and request account deletion as described in the Privacy Policy. Subscription cancellation and organization-controlled record retention are handled separately.
We will post updates to these terms with a revised date and provide notice of material changes. Any subscription price change will be communicated before it applies to a renewal; you may cancel before that renewal. These terms do not limit rights that cannot lawfully be limited.
